San Miguel unit to help MSMEs improve their packaging

THE Department of Trade and Industry (DTI) said it has signed up a unit of San Miguel Corp. to help improve packaging used by micro, small, and medium enterprises (MSMEs).

In a statement on Monday, the DTI said it signed a memorandum of agreement with SMC’s San Miguel Yamamura Packaging Corp. with the aim of offering MSMEs affordable packaging alternatives.

The partnership involves training, coaching, and other measures to upskill and scale up MSMEs’ packaging operations.

 “It is about time that we collaborate, enhance, and push further towards product development, branding, and innovative packaging solutions which are at par with the international standards,” Trade Assistant Secretary Dominic R. Tolentino, Jr. said. — Revin Mikhael D. Ochave

RPT Form — an annual requirement to remember

Do you recall the issuance of regulations and memorandum circulars by the Bureau of Internal Revenue (BIR) during the pandemic on another required attachment to the Annual Income Tax Return (AITR)? This was the requirement to submit BIR Form No. 1709, the Information Return on Transactions with Related Party or simply Related Party Transaction (RPT) Form, and supporting attachments.

As we enter the height of the AITR filing season, it is important to ensure that all required attachments are also complete and compliant. Unfortunately, even though we are already in the third year of implementation, some taxpayers are still not fully aware of the need to submit this BIR form. Below are some basic rules to remember.

WHO IS REQUIRED TO FILE BIR FORM NO. 1709?
Not all taxpayers are required to file the RPT Form. Hence, it is important to assess the status of the taxpayer to identify if it is covered by the requirement.

A taxpayer is required to file an RPT Form if the following conditions are present:

1. It is required to file an Annual Income Tax Return (AITR);

2. It has transactions with a domestic or foreign related party during the concerned taxable period; and

3. It falls under any of the following categories:

a. Large taxpayers

b. Taxpayers enjoying tax incentives, i.e., Board of Investments (Bol)-registered and economic zone enterprises, those enjoying Income Tax Holidays (ITH) or are subject to a preferential income tax rate

c. Taxpayers reporting net operating losses for the current taxable year and the immediately preceding two consecutive taxable years

d. A related party that has transactions with (a), (b) or (c) of the sub-criteria above.

On the other hand, if a taxpayer does not meet the conditions set forth during the taxable year, such a fact should be properly disclosed in its Notes to Financial Statements, as mentioned in Revenue Regulation (RR) No. 34-2020. Also, taxpayers are recommended to regularly monitor the above conditions as there are many factors that may affect the taxpayer’s current state of meeting them, hence requiring them to submit the RPT Form.

THE RPT FORM
The RPT Form is a three-page tax form that has sections for detailed information about the taxpayer, its foreign and domestic related parties, related party transactions, and other disclosures.

Most of the information required can be easily supplied. One required piece of information that taxpayers find difficult to answer is the question of whether the foreign related party has a permanent establishment (PE) in the Philippines. The Philippines has executed over 40 tax treaties, and a majority of them define PE as a fixed place of business through which the business of an enterprise is wholly or partly carried out. Additionally, a PE can also be created due to the presence of a place of management; a branch; an office; a factory; a workshop; a mine, an oil, or gas well; building sites, construction or assembly projects that last for a defined period; the furnishing of services through the presence of employees, agents, or representatives in the Philippines for a defined number of days, depending on the extent or nature of activities pursued in the Philippines, among others. Taxpayers need to refer to the applicable tax treaty in completing Part II of the form.

In Part III, a column is dedicated to the availability of treaty benefits granted to the taxpayers on the RPT. It prompts the taxpayers to secure their approved request for confirmation (RFC) or Tax Treaty Relief Application (TTRA), whichever is applicable, on the use of preferential rates on their disclosed RPT. A detailed description of the nature of RPT must also be indicated.

Note that the RFC with complete documentary requirements is a separate requirement of the BIR for cross-border transactions. It must be filed with the International Tax Affairs Division (ITAD) at any time after the close of the taxable year, except capital gains tax, but not later than the last day of the fourth month following the close of such a taxable year when the income is paid or becomes payable, or when the expense/asset is accrued or recorded in the books, whichever comes first.

Lastly, in Part IV of the form, the taxpayer must also provide the business overview of its ultimate and immediate parent/s; its functional profile and any change therewith; any change to its ownership structure or if it has undergone a business restructuring during the taxable year; if transfer pricing documentation (TPD) has been prepared in relation to the RPT disclosed; and details of any pending application for relief with the BIR, among others.

Note that all RPTs should be disclosed, regardless of their value. The form must be completely and truthfully completed by the taxpayer or its authorized representative, with no required information left unanswered. For portions that are not applicable, such a fact must be stated.

THE NEED FOR FILING
The BIR clearly conveyed in RR No. 19-2020 that transactions around the world have become more complex through the years. Some transactions between related parties were structured to evade taxes, considering the different tax jurisdictions with different income tax rates and unreasonable transfer prices. Thus, the tax base in high tax jurisdictions is eroded and transferred to low tax jurisdictions. This ultimately leads to less tax collection by the tax authorities. In response to this worldwide dilemma, the BIR launched this requirement to gather information to perform transfer pricing risk assessment and eventually collect deficiency taxes, if any. 

As the RPT Form also requires the disclosure of the amounts involved in the transactions, the BIR can use these to verify whether the RPTs are at arm’s length prices or not. This is why the taxpayer should be able to establish on its TPD that the transactions comply with the arm’s length principle. Though the TPD is no longer required to be attached to the RPT Form, it should be made available during audit, according to Revenue Memorandum Circular No. 54-2021. Hence, the TPD should be prepared contemporaneously at the time of the occurrence of the transaction.

In addition, the Department of Finance (DoF) boldly announced last month that it would meet or exceed the P2.599 trillion revenue collection target set for the BIR in 2023. The means for doing so are digitalization and improved taxpayer services. Undoubtedly, it is expected that one way to hit this target is through tax assessments, which include deficiency taxes assessed due to transfer pricing issues with related parties.

METHOD OF FILING
Being an attachment to the AITR, the RPT Form and its supporting documents can be filed manually or through the BIR’s Electronic Audited Financial Statements (eAFS) System.

A penalty of between P1,000 and P25,000 will be imposed for failure to file the RPT Form and its supporting documents.

MOVING FORWARD
Aside from just meeting the deadline for submission of the RPT Form, taxpayers should carefully and accurately provide all the information needed in the RPT Form. The BIR is continuously building its capacity to conduct transfer pricing assessments. Hence, taxpayers can expect that the BIR will be purposefully evaluating RPT forms and assessing whether the taxpayer is compliant with the RPT regulations.

THREE more bonuses plus one last ticket to the quarterfinals are still up for grabs in the PBA Governors’ Cup.

And with three playdates left, multiple teams are very much in the running with no plans of letting up for an expected mad dash to the finish of the season-ending conference elims.

Only the top four teams will claim twice-to-beat incentives and pace-setting Talk N’ Text, at 8-1, so far is the first to secure it — leaving San Miguel Beer (SMB) (7-2), reigning champion Barangay Ginebra (7-2), NLEX (7-3), Meralco  (7-4) and Magnolia (6-4) in a wild mix.

SMB, Ginebra and NLEX — of all teams — enjoy an inside track as they only need to take care of their remaining assignments to get in the Top 4. The Beermen and the Gin Kings have to win only one of their last two games while NLEX has to get the job done against SMB next Wednesday.

Meralco and Magnolia, for their parts, need all the stars to align with losses of their counterparts to force tie at 7-4 among multiple teams for a complication set to be determined by point differentials.

“We knew this would be a big game in terms of us taking over the hump and getting to the top four. I think officially though, we still have to get one of our next two to qualify to the top four,” said coach Tim Cone as Ginebra bumped Converge (6-5) out of the playoff bonus race with a 120-101 victory over the weekend.

“We needed the win against Terrafirma to maintain our standings in the Top 4. Now, we have to think of ways to beat SMB in our last game,” said NLEX mentor Frankie Lim as a win versus the Beermen would secure them a bonus.

San Miguel has Rain or Shine and NLEX in its schedule, Ginebra has Terrafirma and TNT, Magnolia has Blackwater while Meralco just finished its campaign with a 92-86 win over Phoenix, which is still hanging on to dear life for the last and eighth quarterfinal slot. Phoenix wrapped up its schedule at 4-7, needing a Northport (3-7) loss against TNT in the penultimate playdate next Wednesday after the PBA All-Star break this weekend to complete the playoff cast. Otherwise, the Fuel Masters and the Batang Pier would slug it out in a playoff for No. 8.

Converge, despite a crucial three-game losing skid in the homestretch, is already in the bottom half of the quarterfinals though its final seeding is yet to be determined pending the remaining matches.

Rain or Shine (2-8), Terrafirma (2-8) and Blackwater (1-9) are already out of contention regardless of the results of their remaining games.

The PBA will have a playdate tomorrow in Antipolo featuring Magnolia-Blackwater and Ginebra-Terrafirma before a week-long break for the return of the All-Star Weekend in Passi City, Iloilo.

TNT and SMB, fresh off their campaigns in the East Asia Super League, plunge back to action next Wednesday vs Northport and NLEX, respectively, followed by the last matches of SMB-ROS and TNT-Ginebra on Friday to determine the fortunes of the remaining teams still in contention. — John Bryan Ulanday

Teener Arca bests older rivals  at National Age Group Championships

PRODIGIOUS Christian Gian Karlo Arca is being tipped as the future of Philippine chess.

Over the weekend in Tagaytay, the 13-year-old Mr. Arca’s brilliance was in full display as he bested older, more experienced rivals to top the premier Open Under-18 (U18)class of the Vice Gov. Athena Tolentino National Age Group Championships.

Mr. Arca finished unbeaten with six points out of a possible seven including a final-round victory over Jerish John Velarde and took the crown in the strongest division of the four-day meet ahead of top seed Cyrus Vladimir Francisco and Del Emerson dela Cruz, who ended up second and third, respectively, with 5.5 apiece.

The eighth-grader from Dasmariñas Integrated High School has been impressive for a year now and one of his most memorable feats came in the Manny Pacquiao International Open in General Santos last December when he slew Moldovan International Master Dragos Ceres.

While there’s more work to be done, Mr. Arca should improve and realize his potential as a future Grandmaster, possibly in the mold of Cavite-born American Wesley So.

Other winners of the event bankrolled by Abraham Tolentino, who is also a National Chess Federation of the Philippines (NCFP) vice president apart from being a Cavite vice governor, were Franchesca Largo (U18), John Cyrus Borce and Jersey Marticio (U16), Keith Adriane Ilar and Kaye Lalaine Regidor (U14), Mar Aviel Carredo and Zhaoyu Capilitan (U12), and Steve Zacky Bolico and Mary Janelle Tan (U10).

Creamline eyes semifinals berth against dangerous PLDT High Speed Hitters

EXCEPT for one forgettable endgame collapse that slowed it down, Creamline has so far lived up to expectations that it will make the Premier Volleyball League All-Filipino Conference semifinals first.

But the Cool Smashers would have to hurdle the dangerous PLDT High Speed Hitters today (March 7) at the PhilSports Arena in what could be a sneak preview of this conference’s finals if they want to get that distinction as the first semifinalists.

The titanic duel between Creamline and PLDT, currently the league’s top two squads with a 5-1 and 4-1 record, respectively, is set at 4 p.m. and a win by the former would propel it straight to the single-round robin phase.

If PLDT prevails, it will move a step closer to the semis.

And Creamline coach Sherwin Meneses knows they’re in for possibly one of the toughest games to date since their fifth-set implosion in a heartbreaking 23-25, 25-18, 16-25, 25-23, 16-14 defeat to F2 Logistics last Feb. 18 also at the Pasig venue.

“We expect a tough game,” said Mr. Meneses.

But the Cool Smashers looked recharged more than two weeks after their F2 debacle and played just one game since then — a walk-in-the-park 25-12, 25-20, 25-12 demolition of the Army Black Mamba Lady Troopers last Feb. 28.

Jema Galanza, who was under the weather and sat out last game, is expected to be back.

PLDT, for its part, has been on a tear as it has strung together four straight wins, including a 25-14, 21-25, 25-12, 25-15 triumph over Akari a week back, since dropping a five-setter to F2, 25-22, 25-21, 14-25, 20-25, 16-14, exactly a month ago.

One of the biggest reasons PLDT is on the rise has been Michelle Morente, an acquisition from Army this season who is playing possibly the best volleyball of her life.

In their last outing, the energetic Ms. Morente dropped a team-high 14 points.

COLLEGE of St. Benilde (CSB) is on course of matching its historic sweep of NCAA volleyball a year ago after hurdling its first five assignments this season.

Standing in the way is a dangerous Mapua University side, a team no one expected to threaten the big guns but has defied the odds and leapfrogged to a joint second in NCAA Season 98 Volleyball at the San Andres Complex.

While the Lady Blazers are unbeaten in five starts, the Lady Cardinals have stayed close and fought their way to No. 2 alongside the proud University of Perpetual Help Lady Altas with a 4-1 record apiece.

They clash at 2 p.m. in what could be a preview of a potential semifinal or final clash.

But unlike a season ago when CSB had an intact roster, CSB coach Jerry Yee, who steered his wards to an 11-game title sweep in Season 97, has tempered expectations after their team captain Mycah Go was ruled out for the whole of their campaign due a torn ACL (anterior cruciate ligament) she suffered last January.

But minus the cerebral and talented Ms. Go, the Lady Blazers have responded to the challenge and pulled off five straight wins that included a gripping five-setter and a four-setter that they eventually survived to stay unscathed.

In contrast, Mapua University has fought tooth and nail to get to where it is right now as it bounced back from their first-game defeat to Lyceum of the Philippines University (LPU) by winning its next four assignments.

Interestingly, the Clarence Esteban-mentored Lady Cardinals may come in tired and weary after playing a total of four five-setters and one four-setter in that excruciatingly tough stretch.

Novak Djokovic withdraws from Indian Wells amid US visa row

LOS ANGELES — Novak Djokovic has formally withdrawn from the draw for the Indian Wells tournament, organizers said on Sunday in an indication that the world number one’s application for a COVID-19 vaccine waiver to enter the US might have failed.

The Serbian, who is one of the most high-profile athletes unvaccinated against the virus, applied to the US government last month for special permission to play at ATP Masters events at Indian Wells and Miami.

“World No. 1 Novak Djokovic has withdrawn from the 2023 BNP Paribas Open. With his withdrawal, Nikoloz Basilashvili moves into the field,” organizers said in a statement late on Sunday.

The US currently bars unvaccinated foreigners from entry into the country, a policy that is expected to be lifted when the government ends its COVID-19 emergency declarations on May 11.

Mr. Djokovic has not competed at the back-to-back ATP Masters events in Indian Wells and Miami, two of the biggest tournaments on the ATP calendar and known as the “Sunshine Double,” since 2019.

No one from Mr. Djokovic’s team was immediately available to comment on the withdrawal.

Last Friday, Florida Senators Rick Scott and Marco Rubio wrote a letter to US President Joseph R. Biden urging him to grant the waiver request.

Indian Wells tournament director Tommy Haas, the United States Tennis Association and the US Open were among those also hoping the 22-time Grand Slam champion would be allowed to enter.

He would have been a heavy favorite to win his sixth Indian Wells title when the tournament kicks off in the Southern California desert on Wednesday.

Mr. Djokovic, who missed last year’s Australian Open due to his vaccination status and was not allowed into the US for last year’s US Open, has said he would skip Grand Slams rather than have a COVID shot.

He won his record-tying 22th major championships at the Australian Open in January. — Reuters

PHL women’s cycling team joins 13th Biwase Cup in Ho Chi Minh

EYEING to gain traction in preparation for this May’s Phnom Penh Southeast Asian Games, the Philippine women’s road team sees action in the 10-stage 13th Biwase Cup starting tomorrow in Ho Chi Minh City, Vietnam.

The seven-strong squad left the country yesterday as it embarks on a mission of performing well in the race being used as part of its preparation for the biennial event where it seeks to strike gold.

“The goal is for our women’s team to get at least one foreign exposure ahead of the Southeast Asian Games,” said Phil Cycling chief and Philippine Olympic Committee (POC) President Abraham Tolentino.

Mathilda Krog, Kate Yasmin Velasco, Avegail Rombaon, Marianne Dacumos and Mhay Ann Lina will spearhead the team that will be reinforced by Jelsie Sabado and Maurie delos Reyes after some of the mainstays begged off due to school commitments.

Marita Lucas, Alfie Catalan and Joey de los Reyes are coaching the squad bankrolled by the POC, Philippine Sports Commission, Tagaytay City, MVP Sports Foundation, Standard Insurance, Excellent Noodles and 7-Eleven.

The race, which covers 1,101 kilometers of roads until March 17, unfurls with a 66km criterium around Binh Duong New City.

Mr. Tolentino said the whole team, which included the mountain bikers, will go into a training camp after the Ho Chi Minh tilt. — Joey Villar

South Korea, Japan reach deal to mend relations

SOUTH KOREA and Japan signaled a breakthrough to end a feud that had damaged ties from everything from trade to security, drawing praise from President Joseph R. Biden as he seeks to convince the two US allies to work together in his efforts to counter China.

South Korean President Yoon Suk Yeol’s government said Monday that it would seek to resolve the dispute by having local companies create a fund to compensate people who were forced to work for Japanese companies during the country’s 1910-45 colonization of the Korean Peninsula. Japan’s foreign minister, Yoshimasa Hayashi, welcomed the effort to “return ties to a healthy state,” fueling speculation that both sides could roll back trade measures.

“The government hopes to build a future-oriented relationship between Korea and Japan, based on reconciliation and cooperation,” Foreign Minister Park Jin told a news conference Monday in Seoul. He also called Japan his country’s “closest neighbor” sharing “universal values such as freedom and democracy, market economy, rule of law, and human rights.”

Under Mr. Yoon’s solution, firms such as Posco Holdings, Inc. that benefited from funds transferred under a 1965 treaty with Japan would finance a foundation to compensate the victims. South Korea would withdraw a World Trade Organization complaint over Japanese export controls, paving the way for Tokyo to lift the curbs, the Yomiuri newspaper reported on Sunday.

“Today’s announcements between the Republic of Korea and Japan mark a groundbreaking new chapter of cooperation and partnership between two of the United States’ closest allies,” Mr. Biden said in a statement. “When fully realized, their steps will help us to uphold and advance our shared vision for a free and open Indo Pacific.”

Mr. Yoon, a conservative, has long made clear his determination to mend ties with Japan, which had deteriorated to their worst state in decades under his left-leaning predecessor, Moon Jae-in. Resolving the feud has become more urgent for the US and allies as they attempt to present a more united front against China in the wake of Russia’s invasion of Ukraine last year.

The deal faced an immediate domestic backlash, with the opposition Democratic Party, which has a supermajority in parliament, labeling it “a day of shame” and accusing Mr. Yoon of “subservience to Japan.” Some forced-labor victims insist Japanese companies make a contribution. — Bloomberg

Russia works to ease visa regime for Philippines, 5 other countries

RUSSIA is working on easing visa procedures for six countries, including the Philippines, India and Indonesia, the state TASS news agency cited Deputy Foreign Minister Evgeny Ivanov as saying on Sunday.

“In addition to India (procedures simplification) … is being worked out with Angola, Vietnam, Indonesia, Syria and Philippines,” Mr. Ivanov said.

Earlier, Mr. Ivanov said that Russia is also preparing intergovernmental agreements on visa-free trips with 11 countries, including Saudi Arabia, Barbados, Haiti, Zambia, Kuwait, Malaysia, Mexico and Trinidad, TASS reported.

Since the start of Russia’s full-scale invasion of Ukraine a year ago, which has killed thousands and displace millions, Moscow has turned to China, India and African nations, trying to seek closer ties there.

While the United States, Japan and the European Union condemned Russia’s invasion and imposed sanctions, China and India have not done either.

India kept a neutral stance, declining to blame Russia for the invasion while sharply boosting its purchases of Russian oil. — Reuters

Taiwan warns of Chinese military’s ‘sudden entry’ in areas close to island

TAIPEI — Taiwan Defense Minister Chiu Kuo-cheng warned on Monday the island has to be on alert this year for a “sudden entry” by the Chinese military into areas close to its territory amid the rising military tensions across the Taiwan Strait.

China has stepped up its military activities around Taiwan in recent years, including almost daily Air Force incursions into the island’s air defense identification zone.

However, Taiwan has not yet reported any incident of Chinese forces entering its contiguous zone, which is 24 nautical miles (44.4 km) from its coastline. But it has shot down a civilian drone that entered its airspace near an islet off the Chinese coast last year.

Answering questions from lawmakers in parliament, Mr. Chiu said the Chinese People’s Liberation Army (PLA) might find excuses to enter areas close to Taiwan’s territorial air and sea space as the island steps up its military exchanges with the United States, to Beijing’s ire.

He said the PLA might make a “sudden entry” into Taiwan’s contiguous zone and get close to its territorial space, which the island defines as 12 nautical miles from its coastlines.

“(I) specifically make these comments this year, meaning they are making such preparations,” Mr. Chiu said. “Looking forward, they would use force if they really have to.”

Taiwan has vowed to exercise its right to self-defense and counter-attack if Chinese armed forces entered its territory.

China last year staged unprecedented military exercises around Taiwan in reaction to a visit to the island by US House Speaker Nancy Pelosi.

Mr. Chiu said China is looking to “make trouble under a certain pretext,” adding that might include visits to the island made by foreign senior government officials or Taiwan’s frequent military contacts with other countries.

He said the PLA sends about 10 planes or ships to areas near Taiwan a day. Some of them cross the median line of the Taiwan Strait, which normally serves as an unofficial buffer, on an almost daily basis, he added.

Mr. Chiu said since China has destroyed a tacit agreement on military movements in the Strait, Taiwan has made preparations to “fire the first shot” if Chinese entities, including drones or balloons, enter its territorial space.

China claims self-governed Taiwan as its own and has not renounced the use of force to bring the island under Chinese control, if needed. Taiwan strongly rejects China’s sovereignty claims and says only its people can decide their future. — Reuters

LONDON — Britain’s Prince Harry and his wife Meghan have received an invitation to his father King Charles’ coronation but will not yet confirm publicly whether they will attend, a spokesperson for Harry said on Sunday.

Preparations for the event in May have been overshadowed by the couple’s damning revelations about the King, Prince Harry’s elder brother Prince William and other royals in his recent memoir, a Netflix documentary and a series of TV interviews.

His recent high-profile and stinging criticism of his family had led to speculation over whether Prince Harry, who stepped down from royal duties in 2020, would be invited to the coronation and, if he was, whether he would attend.

“I can confirm The Duke has recently received email correspondence from His Majesty’s office regarding the coronation,” a spokesperson for Prince Harry said.

“An immediate decision on whether The Duke and Duchess will attend will not be disclosed by us at this time.”
