Sanofi to compensate for ‘death, any other case’

FRENCH PHARMACEUTICAL firm Sanofi Pasteur on Monday committed to providing compensation for “death or any other case” among patients who were administered the controversial Dengvaxia vaccine.

Sanofi has also reimbursed to the Department of Health (DoH) P1.16 billion for unused dengue vaccines.

Senators also quizzed incumbent and former DoH officials regarding the process that led to the implementation of the immunization program involving dengue vaccines in 2016.

Senator Richard J. Gordon, chair of the Senate blue ribbon committee, grilled officials of the Disease Prevention and Control Bureau (DPCB) and physicians Maria Joyce U. Ducusin and Mario S Baquilod on the recommendation to include the vaccines in the government’s National Dengue Prevention Program.

Mr. Baquilod said Dr. Rosalind Vianzon, the dengue program manager at the time of the vaccine purchase, told him to make a recommendation which he thereafter submitted to Ms. Ducusin’s office. He also said the rising number of dengue cases at the time also prompted him to issue a document.

It was disclosed that the recommendation document was a requirement for a special allotment order release amounting to P3.5 billion for the vaccine program.

Senator Sherwin T. Gatchalian for his part questioned former health secretary Janette L. Garin for continuing the purchase of the vaccines despite the advice of a technical working group to conduct a pilot testing first.

Ms. Garin said she knew about the proposal for pilot implementation when there was a discussion with other officials regarding four other vaccines proposals for funding. But she said she would have to check with DoH officials regarding the actual document of the technical working group.

For his part, former health secretary Enrique T. Ona testified that he would not implement the government’s anti-dengue vaccine program the way it was handled by his successor while there were still issues about the vaccine.

“It should not have been implemented the way it was done, meaning targeting millions of children, because the basis for the issues that were being raised were still a big question mark,” he said, citing studies too.

He also reiterated his previous statement that the leadership after his term as DoH chief was “solely responsible” for what he called a “major health nightmare in the country today.”

Ms. Garin, the DoH chief at the time the vaccine program was implemented in 2016, insisted that the procurement of the vaccines was not rushed.

Official figure on fatality count in drug war 3,987

THE Philippine Drug Enforcement Agency (PDEA) and other agencies, in a press briefing at Malacañang on Monday, Jan. 22, reported that there were “only 3,987” killed in the government’s antidrug campaign.

This figure stands in sharp contrast to a recent report by Human Rights Watch claiming about 12,000 suspected drug personalities were killed in President Rodrigo R. Duterte’s drug war.

Joining PDEA at Monday’s press briefing were the Philippine National Police (PNP), Presidential Communications Operations Office (PCOO), and Department of Justice (DoJ) as they presented the latest #RealNumbersPh data on the government’s war on drugs.

PNP spokesman Chief Supt. Dionardo B. Carlos explained that out of 19,568 deaths from July 1, 2016 to Jan. 17, 2018, the rest are “homicide cases” that are of “different motives” or not related to the anti-drug campaign.

“The rest are crimes o krimen na nangyayari sa ating mga lansangan. Iba’t-ibang motibo at ang nakikita po natin dito ay ang pinakamalaki po dito ay personal grudge o heated argument, iyong pag-aaway na nauuwi sa pagkamatay ng isang biktima. Ang isa naman pong dahilan, the top three that we see ay iyon pong personal gain, meron po siyang gustong kunin o meron siyang gustong makuha after that incident kung saan nagkakaroon po ng pagpatay sa isang nagiging biktima.”

(The rest are crimes that took place on the streets with different motives. What we see here is that the dominant one is personal grudge or heated argument which led to killing. Another motive is ‘personal gain,’ when one intends to get something after killing the victim.)

Last December, PDEA reported there were only two drug suspects killed in the agency’s almost 3,000 anti-illegal drug operations since it started leading the campaign in October.

For his part, PDEA Spokesperson Derrick Arnold Carreon explained that one factor that led to the notably small number of deaths is the “presence of media during operations,” as “ordered by Director General Aaron N. Aquino.”

“In fact, now, we are moving into inviting prosecutors and to wear body cameras as well, not only our (agents) but also the media and the prosecutors who will be invited in order to make our operations more transparent, and I believe the same move is also being done with our counterparts in the PNP now with resumption of their operations,” Mr. Carreon added.

PDEA also reported yesterday that Mr. Duterte’s anti-drug campaign has led to 81,919 anti-drug police operations and 199,361 arrested drug personalities.

Mr. Carreon said the figures are based on “the consolidated data from the PNP, the National Bureau of Investigation (NBI), the Bureau of Customs (BoC), and the PDEA.”

The agency also reported that it has “confiscated 2,577.05 kilograms of methamphetamine or shabu, with a street value of P13.24 billion, and an increase of P114.16 million from the previous period last month.”

Mayon Volcano rains ash as experts warn of violent eruption

A GIANT mushroom-shaped cloud shot up from the Philippines’ most active volcano on Monday, darkening the skies and raining ash on communities where tens of thousands have fled after warnings of an impending eruption.

Mayon Volcano’s new activity prompted state volcanologists to raise the alert level one notch higher than the initial warning scientists issued last week, meaning a hazardous eruption is possible within days.

Fine ash and sand fell on Legazpi, a city of about 200,000 people, and nearby areas after the midday explosion of Mount Mayon, forcing motorists to turn on their windshield wipers and headlamps, an AFP video stringer said.

Live local television footage and photographs showed the ash column rising several kilometers above the volcano, blotting out the sun in a largely agricultural region some 330 kilometers southeast of Manila.

”I had to stop because my helmet had filled up with ash,” local housewife Girlie Panesa, 39, told AFP as she parked her motorcycle by the roadside in nearby Ligao town.

She asked for water from bystanders to wash the cement-grey ash off her helmet visor and said she plans to drive home despite the hazardous conditions because her teenage daughter was alone in their house.

“We expect the explosions to continue,” Philippine Institute of Volcanology and Seismology (Phivolcs) director Renato U. Solidum, Jr. told a news conference in Manila.

“There is a possibility of a dangerous eruption, the start of which we are already witnessing,” Mr. Solidum added.

He advised local officials to evacuate more areas around the crater, expanding the danger zone from six kilometers to eight kilometers.

EVACUATION
More than 40,000 people had fled in the past week, the civil defence office in Manila said Monday.

As of Sunday, almost 6,500 families composed of 24,381 individuals are still in evacuation centers, according to the Department of Social Welfare and Development (DSWD). These are residents within the seven-kilometer danger zone of the volcano.

A six-kilometer permanent danger zone is set up around Mayon.

In its report as of Jan. 21, the DSWD said it has so far released more than P5 million worth of relief supplies.

DSWD Officer-in-Charge Emmanuel A. Leyco said the DSWD-Field Office in the Bicol Region remains on red alert and continues to assist affected local government units in their relief operations and in managing the evacuation centers that are still open.

Last Thursday, 2,909 families or 12,044 individuals were allowed to return to their homes within the 8-9-kilometer zone following a green light from authorities. They were, however, advised to stay alert.

AIRPORT CLOSED
Meanwhile, the Civil Aviation Authority of the Philippines (CAAP) has temporarily closed the Legazpi Airport effective 2:21 p.m. yesterday afternoon to 9 a.m today.

In its notice to airmen (Notam), CAAP said the closure advisory will be updated on a daily basis depending on Mayon Volcano’s status.

The affected flights are Cebu Pacific’s Manila-Legazpi, Mactan-Legazpi, and Manila-Naga services.

Mayon, a near-perfect cone, rises 2,460 meters above Legazpi and is considered the most volatile of the country’s 22 active volcanoes.

The Philippines is part of the Pacific “Ring of Fire” of islands that were formed by volcanic activity.

The most powerful explosion in recent years was the 1991 eruption of Mount Pinatubo, about 100 kilometers northwest of Manila, which killed more than 800 people. — main report by AFP

MinDA underscores need for Mindanao Railway Corp.

DAVAO CITY — As the national government prepares to break ground for the first phase of the Mindanao Railway System (MRS) by the third quarter this year, the Mindanao Development Authority (MinDA) has underscored the need to set up the Mindanao Railways Corp. (MRC) that will manage and operate the transport network.

MinDA Deputy Director Romeo M. Montenegro, in an interview last week, said the creation of the railway agency has already been given support by several members of the House of Representatives.

A bill on the MRC was initially filed in 2014 and similar bills have been refiled in the current 17th Congress in both the Senate and House of Representatives. The proposal has been approved at the House committee level.

Under the proposal, MinDA would be represented in the MRC board.

MinDA, in a statement, said its inclusion in the board will put “premium in situating the proposed integrated and coordinated transport network and its future expansion along planned development direction for Mindanao.”

The first phase of the MRS would be in the Davao Region, spanning Digos City in Davao del Sur, Davao City, and Tagum City in Davao del Norte. An initial P6.58-billion fund has been allocated for the 105-kilometer segment.

Davao del Norte Governor Antonio Rafael G. del Rosario, chair of the Davao Regional Development Council, has said that the project will boost the local economy’s growth.

“Because there will be faster movement of goods and people, more investors are expected to get attracted to invest in the region,” said Mr. Del Rosario whose father, former governor Rodolfo P. del Rosario, was among those pushing for its establishments. — Carmelito Q. Francisco

Super Bowl: Pats vs Eagles

WASHINGTON — Defending champion New England reached the Super Bowl for the third time in four seasons Sunday, edging Jacksonville, 24-20, to book an NFL championship showdown against the Philadelphia Eagles.

Tom Brady’s two fourth-quarter touchdown passes rallied the Patriots into Super Bowl 52 against an Eagles squad that humbled the NFL’s top-rated defensive unit in routing Minnesota, 38-7.

The Patriots boosted their record of Super Bowl trips to 10 and they could match Pittsburgh’s record six Super Bowl triumphs on Feb. 4 at Minneapolis, Minnesota.

“It’s pretty crazy,” Brady said. “It’s pretty amazing to be on a team that wins these kind of games. It’s so great.”

Nick Foles, who took over as Philadelphia’s quarterback last month after an injury to Carson Wentz, completed 26-of-33 passes for 352 yards and three touchdowns as the underdog Eagles humbled the Vikings.

“This moment, it’s unbelievable. It’s humbling,” Foles said. “The team was amazing. I’m a little speechless. It’s amazing soaking this all in. We all believe in each other. Everyone was against us. We came in here and came out with an amazing victory.”

It will be a rematch of Super Bowl 39 from 2005, when Brady threw two touchdown passes and the Patriots won 24-21 for their third title in four seasons, the same run they could complete in two weeks.

“Now we have to go to Minnesota and finish the job,” said Patriots owner Robert Kraft.

The Eagles, whose two Super Bowl defeats also include 1981, last won a title in 1960 before the Super Bowl era began.

The Vikings, who have not played in the Super Bowl since 1977, squandered a chance to become the first team to reach a Super Bowl in its home stadium. NFL teams based in domed stadiums fell to 0-13 in outdoor conference championship contests.

Five-time Super Bowl champion Brady, who needed stitches for a right hand injury suffered Wednesday in practice, lost his favorite target, tight end Rob Gronkowski, to a second-quarter concussion.

UNKINDEST CUT OF ALL
Brady finally addressed the Wednesday cut to his throwing hand that become a major pre-game concern.

“It was just a pretty good cut. I dealt with it the best I could,” Brady said.

“I’ve had a lot worse. Wednesday, Thursday and Friday were a little scary. I gained some confidence on Saturday and we did just enough to win.”

New England pulled within 20-17 on Brady’s 9-yard touchdown pass to Danny Amendola with 8:44 remaining and the Patriots surged again when Amendola returned a punt 20 yards to the Jaguars’ 30-yard line.

Brady zipped a pass to a diving Amendola that had fans chanting “Bra-dy, Bra-dy” and three plays later connected at the back of the end zone with a high-leaping Amendola, whose acrobatic tiptoe landing while falling ensured a 4-yard touchdown reception and a 24-20 Patriots lead with 2:48 to play.

“It means a lot. We worked so hard for this,” said Amendola, who caught seven passes for 84 yards. “We’re excited for the opportunity.”

New England’s Stephon Gilmore batted down a fourth-down pass to halt the last Jaguars’ drive and Dion Lewis ran for a clinching first down that enabled the Patriots to run out the clock.

Roque defends Duterte, daughter: Give me AMLC-authenticated documents

Roque, Jr. challenged critics and reporters yesterday, Jan. 22, to produce bank statements authenticated by the Anti-Money Laundering Council (AMLC) to support Vera Files’ report alleging that “President Rodrigo R. Duterte and his daughter Davao City Mayor Sara Z. Duterte-Carpio did not declare their P100 million in investments.” “The reality is that the law says that bank statements are in fact confidential and you need a report or a request from the Anti-Money Laundering Council to get copies of these statements. When Vera Files asked me for my comment, how could I comment when the documents are not authenticated?,” Mr. Roque said in a press conference. In a statement forwarded to media on the same day, Ms. Carpio said: “I actually participated in the production of this Vera Files story. I replied and gave my comment and I told them that we continue to question the claims made by Trillanes and the truthfulness in the data he presented. We have also been asking him to produce and present the sources of the data, which he failed to do even today. Because otherwise, if everything is just based on claims, it’s just rumor-mongering. Pacio works to complete unfinished ONE Championship business

HAD his shot at being crowned ONE Championship world champion a year and a half ago, Filipino mixed martial arts fighter Joshua “The Passion” Pacio has only grown motivated to get back to that level and complete what he considers to be an unfinished business.

One of the contenders in the strawweight division of Asia’ biggest sports media property, the 22-year-old Pacio of Baguio City said that while the road to a title contention is not going to be easy, he nonetheless is ready to put in the work and overcome whatever challenges come his way.

“It’s more about consistency. To be consistent inside the cage is what I am for at present. I have to win it all if I want to be back in the title contender’s position. A single loss could bring me back to square one. However, I am willing to work for it,” said Mr. Pacio, who lost to former ONE strawweight champion Yoshitaka Naito in their title clash in October 2016 by submission in the third round due to a rear-naked choke.

He went on to say that he is turning to Team Lakay stable mate and former ONE lightweight champion Eduard “Landslide” Folayang for inspiration, seeing how the latter initially had to deal with a lot of adversities before rising up and becoming one of the best up in the country and in the organization.

“Before he (Folayang) got the belt, he went through a lot of ups and downs in his career. He was beaten and was knocked out twice, but I saw the fight still burning in him. Now, he still goes to the gym and tries to get better and better every day. He taught me a lot about life and its spiritual side, and he taught me positive attitudes that will bring me up in my career,” said Pacio, who is sporting a 10-2 record.

On Friday, Mr. Pacio, who is coming off an impressive knockout victory over compatriot Roy Doliguez last November, returns to the cage at “ONE: Global Superheroes” at the Mall of Asia Arena, taking on China’s Lan Ming Qiang.

It is a fight that Mr. Pacio is putting much weight on, seeing it as an opportunity to highlight how worthy he is of another shot at the title now held by Brazilian Alex Silva.

“Lan Ming Qiang is my new opponent now, and I need to adapt quickly to his style. But our game plan is still the same, and I will execute that on Friday,” said Mr. Pacio even as he underscored Mr. Lan’s (9-0) solid striking skills.

PHL confirms seeking US help for counterterrorism

MALACAÑANG CONFIRMED yesterday, Jan. 22, that the Philippines has asked the United States for help for counterterrorism measures. The spokesman’s pronouncement came after the Wall Street Journal reported over the weekend that the US has launched its “Operation Pacific Eagle” in response to the request of the Philippine government for further help in countering Islamic State-inspired groups in the country. “We asked help from anyone, from all countries of the world because the threat of terrorism is not just in the Philippines, it’s a worldwide concern. So if countries want to give whatever assistance they could and they want to, it’s welcome,” Mr. Roque said. Three Billboards biggest winner at female-flavored Screen Actors Guild awards

LOS ANGELES — Dark comedy Three Billboards Outside Ebbing, Missouri won three prizes at the Screen Actors Guild (SAG) awards on Sunday in a ceremony marked by women and their stories amid the sexual misconduct scandal that has swept Hollywood.

The Fox Searchlight film about a furious woman seeking justice for the murder of her daughter was named best ensemble, the top SAG honor.

Frances McDormand won best actress and Sam Rockwell took home the best supporting actor statuette for their roles in the film.

Britain’s Gary Oldman won best actor for playing wartime leader Winston Churchill in Focus Features’ Darkest Hour.

Allison Janney won for her supporting actress role as a demanding mother in independent ice-skating movie I, Tonya.

The SAG awards are indicators of likely Oscar success in March because actors form the largest group of voters in the Academy of Motion Picture Arts and Sciences.

Oscar nominations will be announced on Tuesday (Wednesday in Manila. — Ed.).

The SAG ceremony took place after two days of marches by hundreds of thousands of women throughout the United States.

Host Kristen Bell said women were having a “watershed moment.”

“Let’s make sure we lead the charge with empathy and diligence because fear and anger never win the race,” said Bell, star of television’s The Good Place.

Accusations of sexual misconduct have forced dozens of powerful men in Hollywood to step down, be fired or dropped from creative projects.

Women, many of them leading actresses, have responded by breaking their silence through the #MeToo social media movement and the Time’s Up campaign for legal support of victims.

On the red carpet, women swapped the black gowns that marked support for victims of sexual harassment at the Golden Globes two weeks ago for brighter blues, green, and metallic hues.

Aziz Ansari, nominated for his Netflix comedy series Master of None, was a no-show on Sunday after making headlines last week when a woman described feeling violated following an awkward date last year. Ansari said he believed their sexual activity was consensual.

Ansari lost the television comedy actor statuette to William H. Macy for Shameless.

James Franco, a best actor nominee for The Disaster Artist, did show up but skipped the red carpet and did not win. Franco had kept a low profile since describing allegations of sexual impropriety against him by five women two weeks ago as “not accurate.”

In television, NBC’s sentimental family drama This is Us was named the best drama ensemble cast in a surprise win over presumed front runners The Crown and dystopian series A Handmaid’s Tale.

The cast of HBO political satire Veep won best ensemble for a television comedy. Julia Louis-Dreyfus, who is undergoing treatment for breast cancer and missed the SAG show, was named best comedy actress.

“She’s genuinely been in good spirits when we’ve seen her, which I think will carry her along … She is incredibly strong and is uniquely able to combat something like this,” Timothy Simons, who plays Jonah Ryan on Veep, told reporters on Sunday.

The Crown’s Claire Foy was named Best Drama Actress, while bagging the best actor and actress in a limited series/TV movie awards were Alexander Skarsgard and Nicole Kidman, both for their work in Big Little Lies.

PCC: Telcos’ SMC asset purchase has performance conditions

THE Philippine Competition Commission (PCC) said the National Telecommunications Commission (NTC) has the authority to take back the wireless frequency from PLDT, Inc. and Globe Telecom, Inc. which they acquired from San Miguel Corp. (SMC) if the telcos do not improve their services.

PCC Commissioner Johannes Benjamin R. Bernabe said that the NTC can “claw back” the permission it gave to the telcos to use the 700 megahertz (MHz) frequency the incumbents acquired in 2016 from SMC, once the NTC reviews the conditions of the approval and finds that the telcos have not met the terms.

His remarks signal a possible scenario for allocating spectrum to a new entrant, the so-called “third player.”

The approval of the use of the 700 MHz came with the condition of improved connectivity, reliability and speed of Internet service, and the one-year period condition has already elapsed. The telcos justified that the acquisition of the much-coveted frequency is for delivering better service to customers.

“It imposed a condition that within one year from the date of approval of co-use, Smart and Globe have to ensure that there is increased capacity, both in terms of broadband and internet access speed. And this one year period has already lapsed and therefore NTC should be able to make a determination whether the right of co-use should be retained or whether or not certain frequencies should in fact be clawed back and allocated in favor of a prospective third telco player…” Mr. Bernabe told BusinessWorld Editor-in-Chief Roby Alampay in a Bloomberg Philippines television interview.

“They can in fact also say, ‘well, maybe you don’t need all the frequencies that we allowed to co-use. And instead of letting you continue using them under the co-use agreement we are now going to allocate it in favor of the third player.’ That is a possibility that, we in the PCC see as being possible.”

Mr. Bernabe said however that the most the PCC can do is “encourage” the NTC to pursue the review.

“They are a co-equal agency in government, the most that we can do perhaps is to encourage them to pursue their review which is their mandate, under these terms of the co-use agreement that they approved and maybe exercise some discretion of terms of what could benefit the consumers the most,” he said.

The competition watchdog is counting on a positive ruling from the Supreme Court (SC) after it questioned the purchase of SMC assets by the incumbents.

The PCC filed an appeal with the Supreme Court over a Court of Appeals (CA) ruling rejecting its bid to review PLDT and Globe’s acquisition of SMC’s telco assets.

In the appeal, the PCC said the CA erred in deciding that the $1.5-billion telecommunications deal was deemed approved.

In October, the CA’s former 12th division ordered the PCC to cease its review of the acquisition of SMC’s assets by the two telco incumbents.

“Hopefully, within the next year or two, the Supreme Court would be able to issue its decision on our appeal,” Mr. Bernabe said.

The PCC expects a favorable ruling to pave the way for farming out frequencies in time for the entry of a third player. The regulator estimates that only 12.8% of the spectrum will be left for a third player.

The third player also could end up paying around P3 billion for the 3G (third generation) frequency surrendered by PLDT, required by the government when it approved a merger with Digitel Telecommunications Philippines, Inc.

Department of Information and Communications Technology (DICT) Officer-in-Charge Eliseo M. Rio, Jr. said compensation is still needed, and the third player, if interested in acquiring the 3G frequency, will have to assume the responsibility of compensation.

Mr. Rio said that the remaining frequencies are “enough” for the third player to compete with PLDT and Globe. The DICT however, is looking at a “more equitable” allocation of frequencies in the long term, and this would possibly include reallocation or re-farming of frequencies.

However, Mr. Rio admitted this would take a long process and cannot immediately be carried out.

PLDT and Globe have said they are wary of the government’s reallocation plans, adding that they are using the 700-MHz frequency band.

Hastings Holdings, Inc., a unit of PLDT Beneficial Trust Fund subsidiary MediaQuest Holdings, Inc., has a stake in BusinessWorld through the Philippine Star Group, which it controls.

PHL fintech firm to open office in Tokyo

LOCAL FINANCIAL technology firm Appsolutely is entering the Japanese market to boost the regional adoption of its proprietary digital currency in its bid to become a global company.

In a statement, the company announced that it is opening an office in Tokyo before the end of the month, with an expansion in Osaka also in the pipeline.

The company has already established LoyalCoin’s presence in the United States and Thailand.

“Appsolutely sees Japan as an important market for LoyalCoin and its loyalty solution LoyalPlatform due to the country’s high-level acceptance and enthusiasm for blockchain and digital currencies,” the company said.

Senator Poe tells LTFRB to explain cap on ride-sharing units

SENATOR GRACE Poe Llamanzares, chair of the public services committee, called on the Land Transportation Franchising and Regulatory Board (LTFRB) to “explain the science” behind its decision to cap the number of Grab, Uber and other ride-sharing units at 45,000 in Metro Manila, 500 in Metro Cebu, and 200 in Pampanga. “What’s the math used in this decision? What were the parameters used, like demand and supply?” Ms. Poe said in a statement released yesterday. The LTFRB recently issued Memorandum Circular 2018-003, which set a “common supply base” for transport network vehicle service (TNVS) providers. The LTFRB has assured the public that the base will be reviewed every quarter and adjusted correspondingly based on “churning rate.” Ms. Poe, however, pointed out that, “The review should not just be based on the churning rate, which is the number of vehicles that are no longer in the system. Instead, it should be based on an algorithm that determines supply and demand. The cap will also affect not just the TNCs but the livelihood of drivers of TNVS. Given that there are currently about 100k (thousand) TNVS combined, and this number is not enough to satisfy the demand of the public, then we should start with that as the base and adjust accordingly.”
